1. Acceptance of Terms

By accessing or using the website sarvaya.in and any services provided by SARVAYA, you agree to be bound by these Terms of Service. If you do not agree with any part of these terms, you must not use our website or services.

2. Services

SARVAYA provides digital services including but not limited to web development, app development, UI/UX design, SEO, AEO/GEO optimization, AI automation, brand identity, marketing, business consulting, and white-label services. The specific scope, deliverables, and timeline for each project will be agreed upon in writing before work begins.

3. Client Obligations

As a client, you agree to:

• Provide accurate and complete information required for the project
• Respond to communications and requests for feedback in a timely manner
• Ensure that any materials you provide (logos, text, images) do not infringe on third-party rights
• Make payments as agreed upon in the project proposal

4. Payment Terms

Payment terms will be outlined in individual project proposals. Unless otherwise stated:

• A deposit may be required before work begins
• Final payment is due upon project completion and delivery
• Late payments may incur additional charges
• All prices are quoted in INR unless otherwise specified

5. Intellectual Property

Upon full payment, all intellectual property rights for custom work created specifically for your project will be transferred to you. SARVAYA retains the right to showcase completed projects in our portfolio unless a confidentiality agreement states otherwise.

Third-party assets (fonts, stock images, plugins) remain subject to their respective licenses.

6. White-Label Services

For white-label engagements, SARVAYA agrees to maintain strict confidentiality regarding the partnership. All deliverables will be provided without SARVAYA branding. Both parties will adhere to any NDA signed as part of the engagement.

7. Revisions & Modifications

Each project includes a defined number of revision rounds as specified in the proposal. Additional revisions beyond the agreed scope may be billed separately. Major scope changes after project commencement may require a revised proposal and timeline.

8. Limitation of Liability

SARVAYA shall not be liable for any indirect, incidental, or consequential damages arising from the use of our services or website. Our total liability shall not exceed the amount paid by the client for the specific service in question.

9. Termination

Either party may terminate a project engagement with written notice. In the event of termination:

• Payment is due for all work completed up to the termination date
• Any deposits paid may be non-refundable depending on work already completed
• Completed deliverables will be handed over upon settlement of outstanding payments

10. Website Usage

You agree not to use our website to:

• Transmit harmful, offensive, or illegal content
• Attempt to gain unauthorized access to our systems
• Reproduce or distribute our content without permission
• Use automated systems to scrape or extract data

11. Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of India. Any disputes arising from these terms shall be subject to the exclusive jurisdiction of the courts in Jaipur, Rajasthan.

12. Changes to Terms

We reserve the right to modify these Terms of Service at any time. Changes will be effective immediately upon posting to the website. Continued use of our services constitutes acceptance of the updated terms.
